1. Introduction & Scope

EPK ENJDN is an educational decision-support platform designed to help you understand your lifestyle and performance data. We do not diagnose, treat, or replace medical care. This policy explains how we collect, use, and protect your data when you visit our website, manage your membership, or interact with the EPK ENJDN app.

2. The Information We Collect

We collect data to deliver our services, process payments, and improve our digital platform. This falls into three distinct categories:

a. Account & Transaction Data

We collect your name and email address to create your account. A phone number and shipping address are only collected if you voluntarily request physical items, such as a welcome pack. We track your payment status and subscription identifiers, but we do not collect or store your billing details or full card numbers; this is handled entirely and securely by our payment processor - Stripe.

b. Technical & Marketing Data

As you navigate our website and app, we collect IP addresses, browser types, device information, and engagement data via cookies, local storage, web beacons, and tracking pixels to measure platform performance, ensure resilience, and optimize marketing effectiveness.

c. Connected Wearable Data (In-App Only)

Upon activating a paid membership, you may optionally connect third-party aggregators (such as Apple Health - See the Apple Health Privacy Policy) to enhance your assessments. This integration occurs exclusively within the secure, authenticated environment of the EPK ENJDN app. When initiating a connection, you will be directed through the provider’s native authorization interface (OAuth), where you retain granular control to individually select and toggle the specific data points you permit us to read. Depending on your manual selections, this may include daily activity levels, estimated energy expenditure, and physiological recovery metrics. We process only the metrics you explicitly authorize, and solely for the purpose of generating the educational reports and guidance outlined in your membership agreement.

Revoking Third-Party Access: If you choose to link a third-party wearable or aggregator (such as Apple Health) to your EPK ENJDN account, you may limit or revoke our access to that data at any time via the settings within that third-party platform. Please note that revoking access only prevents the future collection of data. It does not automatically delete historical data we have already received and processed. To delete your historical data, you must submit a formal erasure request to privacy@enerjarden.com.

d. User-Provided Content

To calibrate your performance baselines, we collect basic physical and activity metrics when you set up your account. Additionally, if you choose to manually log performance feedback, lifestyle habits, or submit files and multimedia (such as a profile picture) within the app, we process this data strictly to populate your profile and tailor your educational Generated Insights.

3. How We Use Your Data

To Provide Our Service (Contract)

Managing your subscription, delivering requested kits, and generating your EPK ENJDN assessments.

To Improve & Secure the Platform (Legitimate Interest)

Using technical analytics to troubleshoot bugs, secure our servers, and optimize the user interface.

To Market Our Services (Consent / Legitimate Interest)

Serving relevant digital advertising and sending relevant information via email based on your browsing behavior on our marketing site. You can opt out of marketing communications at any time.

To Generate Insights (Explicit Consent)

Calculating your educational guidance requires processing the Connected Wearable Data you voluntarily authorize in-app. Our algorithms generate educational traffic-light states and performance prompts; however, these outputs are for informational purposes only and do not constitute automated decision-making that produces legal or significantly similar effects under UK GDPR. You can revoke your data connection at any time.

4. Third-Party Integrations & Sharing

We never sell your personal data. To operate efficiently, we share specific data subsets on the principle of 'least information' with vetted third-party service providers. We are actively practicing "data minimization" which is a core requirement of Article 5 of the UK GDPR.

The Data Firewall: We strictly silo your in-app assessment data. We do not sell, share, or sync your Connected Wearable Data (including data read from Apple Health or Google Health Connect) with any data brokers, advertising networks, or marketing platforms. Information collected via Apple HealthKit or Google Health Connect is used solely to provide and improve your educational fitness and performance insights within the EPK ENJDN app, and is strictly never used for advertising, marketing, or other use-based data mining purposes.

Providers used for standard business operations:

  • Infrastructure & Security: We use Cloudflare for app hosting and security, and Webflow for our website architecture.
  • Analytics & CRM: To understand customer journeys and manage communications, we use HubSpot, PostHog, Mixpanel, and Dreamdata.
  • Advertising & Tracking: We use Google Tag Manager and Usercentrics to manage our tracking technologies. To measure ad performance and serve relevant content, we utilize tracking pixels from Google, Meta, Microsoft/Bing, Snapchat, and LinkedIn.
  • Payment Processing: All secure payments are handled by Stripe. In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna’s own privacy notice.

    5. Data Retention & Deletion

    We retain your data only for as long as necessary to fulfill the purposes outlined in this policy:

    Active Accounts

    Data is retained while your account remains active to provide your ongoing service.

    Inactive Accounts

    If your account is deactivated, your membership is unpaid, or access is otherwise removed, we will securely delete your account data 1 year from the date of deactivation.  

    Right to Erasure

    If you submit a valid deletion request to privacy@enerjarden.com, we will execute the full deletion of your account and associated data within 48 hours.

    6. International Data Transfers

    Some of our technology providers are based outside the United Kingdom (e.g., in the United States or the European Union). Whenever we transfer your personal data out of the UK, we ensure a similar degree of protection is afforded to it by utilizing approved legal frameworks. This includes standard contractual clauses, the UK Extension to the EU-US Data Privacy Framework, or recognized adequacy decisions under the UK GDPR for transfers to the European Economic Area.

    7. Your Data Rights

    A. Under data protection laws, you have the right to:

    • Request access to your personal data.
    • Request correction of inaccurate data.
    • Request the erasure of your data.
    • Object to processing (including direct marketing).
    • Request the restriction of processing.
    • Withdraw consent at any time (where we rely on consent).

    To exercise any of these rights, please email privacy@enerjarden.com. To prevent unauthorized data disclosures, we reserve the right to ask for specific information to confirm your identity before processing any access, correction, or deletion requests. If you feel your concerns have not been addressed, you have the right to lodge a complaint with the Information Commissioner's Office (ICO), at ico.org.uk.

    8. Children's Privacy

    Our products and services under the EPK ENJDN brand are intended strictly for users aged 18 and older. We do not knowingly collect personal data or performance metrics from anyone under 18. If we become aware that a user under the age of 18 has misrepresented their age, bypassed our eligibility restrictions, and submitted personal data to our platform, we will take immediate steps to terminate the account and delete such information from our systems.

    9. Changes to this Privacy Policy

    We reserve the right to update or modify this Privacy Policy at any time to reflect changes in our operational practices, technology stack, or legal requirements. If we make material changes to this policy, we will notify you by updating the "Last Updated" date at the top of this document and posting the revised version on our website. Where appropriate - such as significant changes to how we handle your Connected Wearable Data - we will also notify active members directly via email or/and an in-app notification. Any modifications will be effective immediately upon posting. Your continued use of the EPK ENJDN website and app platform after the effective date of any updated policy indicates your acknowledgment of the modified terms.
